TERMS AND CONDITIONS – SDC

SOCIEDAD DEPORTIVA CORRECAMINOS (hereinafter, “SDC”) regulates the Terms and Conditions of Use for the Web sites: valenciaciudaddelrunning.com/en/marathon and 
valenciaciudaddelrunning.com/en/half/ (hereinafter, the “Web”) that it manages.

TERMS AND CONDITIONS OF WEB USE

By using the Platform, the User expressly and unreservedly accepts these Terms and Conditions (hereinafter the “Conditions”), which shall govern relations between the parties. Should you not agree with the conditions set out herein, we strongly advise you not to use the Web.

Purpose and scope of the Web application

These Terms and Conditions regulate Users use of the Web. All and any of these Conditions may be modified by the SDC as it deems fit. Modifications to the Conditions will be published and/or notified to Users through the means available. The modifications shall be applied as soon as they enter into force.

Notwithstanding the foregoing provision, the use and/or contracting of certain products/content may be subject to special conditions, of which Users will be properly notified. Special Conditions shall prevail over General Conditions.

‘User’ shall refer to any person browsing the Web.

Access to the Web and its content is free. Nevertheless, use of the Web means the User’s acceptance of the Conditions set out herein.

Users must be over the age of 18 and have sufficient legal capacity to assume the commitments and obligations arising from their acts on the Web. The Web content is not intended for minors.

The SDC as owner of the Web is empowered to suspend, modify, restrict, or interrupt the use of the Platform by Third Parties without any requirement to issue previous notification. No liability or damages whatsoever shall arise from SDC’s exercise of said powers.

Rules governing use of the Web

Users can use the Web providing they abide by these Conditions and comply with the legislation in force.

It is strictly forbidden to access and/or use the Web for illegal and/or unauthorised purposes. The following non-exhaustive list gives illustrative examples of forbidden activities. These are ones:

  • that involve illegal use of the Web and/or that run counter to Public Order and/or that are in bad faith or are unethical;
  • that may or are intended to spread information, images or material of a defamatory/offensive/racist/xenophobic nature, etc.;
  • whose purpose is to perpetrate identity theft of Third Parties and/or to sow confusion concerning the User’s identity;
  • that transmit, install, spread etc. any virus, malware, harmful files and so on and/or that either attempt to or manage to defeat the Web’s security measures; engage in activities (such as but not limited to hacking and phishing) and/or that attempt to access parts of the Platform to which Users are barred or to servers and/or to connected networks;
  • that may harm or interrupt the Web’s workings, including activities such as those that overload the Web’s infrastructure.

SDC reserves the right to take legal and/or other actions against those who fail to observe the Web Terms of Use.

Web Intellectual and Industrial Property Rights

SDC owns and/or has the corresponding licenses covering the use and exploitation of the intellectual and commercial property found on the Web, including all its content (pictures, videos, illustrations, logos, brands, texts, and so forth). SDC reserves all intellectual and industrial property rights over the Web content.

In no case shall access to and use of the Web be understood as transmission, renunciation, or granting (whether in part or in whole) of SDC ‘s rights to the User and/or a Third Party. The rights of Users and/or Third Parties are limited to the use of Web content during their web browsing.

Neither Users nor Third Parties shall make use of the brands, logos, trade names, or any other distinctive mark found on the Platform save where the owner gives its express prior written consent to do so.

Likewise, it is forbidden to modify, copy, reproduce, publically communicate, transform and/or distribute the Web content whether in whole or in part, no matter what the purpose. The only exception to this prohibition is where the owner of the rights gives its prior express written consent to do so.

Similarly, SDC also forbids the modification and/or manipulation of any of the Web’s Contents.

The Web’s Contents shall not be extracted by Third Parties whether by manual or technical means of any kind.

Where Users and/or Third Parties enter information on the Web, they shall bear sole responsibility for ensuring that said information does not infringe the rights of Third Parties — for instance, rights covering intellectual property, commercial secrets, confidentiality. Users and Third Parties shall hold SDC harmless should they fail to do so.

Should Users and/or Third Parties become aware that certain Content is illegal and/or contravenes intellectual and/or industrial property rights, they shall immediately notify SDC of such circumstance.

Web links

The Web may show links to other web pages through various media (links, banners, buttons, etc.). The SDC informs Users that these links are managed by Third Parties and fall outside SDC ‘s control. Thus SDC shall not be liable in any way, shape or form for matters arising from web site links.

The inclusion of links on the Web does not imply any relationship, collaboration, or any other link between SDC and the owner/manager of the linked web page.

Should Users become aware that the Content of these Third Party web sites is illegal and/or contravenes intellectual and/or industrial property rights, they shall immediately notify SDC of such circumstance.

Guarantees and responsibilities regarding web sites

SDC does its utmost to make its Web content reliable and accurate. However, it cannot guarantee that errors will not occur despite the range of measures it takes to avoid them and to ensure that the Web meets the highest standards.

Accordingly, SDC shall not be responsible for:

  • making the Web and its content and services etc. available 100% of the time
  • the absence of errors on the Web
  • the absence of viruses and other harmful systems
  • Web vulnerabilities

Should the Web User become aware of content that is illegal and/or of service failures and/or the presence of virus, he must notify SDC immediately so that we can take the steps needed to put things right.

Processing of Personal Data on the Web (Data Protection)

SDC hereby states that its policy concerning the protection of personal data is enshrined in and regulated by the Web’s Privacy and Cookies Policy, said policy forming part of these Terms and Conditions.

 

APPLICABLE LEGISLATION AND JURISDICTION

Both use of the Web and the contracts that arise from it shall be governed by the laws of The Kingdom of Spain.

Any dispute arising from or bearing on the use of the Web and the contracts stemming therefrom shall fall within the jurisdiction of the courts of the City of Valencia (Spain).

 

RUNNERS SERVICE CENTRE

The Runners Service Centre (hereinafter “SAC” and/or “the Service”) is a service provided by SOCIEDAD DEPORTIVA CORRECAMINOS to all citizens whether or not they take part in the various races. These Terms and Conditions apply solely to the SAC and complement the General Terms and Conditions stated earlier.

The channels through which these services are provided are:

Office Hours:

E-mails will be logged 24-hours a day, 365 days a year. How swiftly we answer them depends on the availability of operators. We strive to answer all queries as quickly as possible.

The Service is free and there is no additional charge for it on Users’ telephone bills.

Users must be over the age of 18 and have sufficient legal capacity to assume the corresponding commitments and obligations. The Service does not cater to minors.

SDC as manager of the SAC is empowered to suspend, modify, restrict, or interrupt the use of the Service without any requirement to issue previous notification. No liability or damages whatsoever shall arise from SDC’s exercise of said powers.

SAC Guarantees and Responsibilities

SDC strives to provide a quality service and give reliable, accurate answers. If there is a glitch, we will do whatever is takes to get the Service back to running the way it should.

Should the Platform User become aware of content that is illegal and/or of service failures, the presence of virus etc., he must notify SDC immediately so that we can take the steps needed to put things right.

Processing of Personal Data on the Platform (Data Protection)

Applicable legislation and jurisdiction

The Service is governed by Spanish Law and any dispute arising from or bearing on the use of the SAC and the contracts stemming therefrom shall fall within the jurisdiction of the courts of the City of Valencia (Spain).
